8. Limitation of Liability

To the maximum extent permitted by applicable law, IronRoot Fitness, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, personal injury, or property damage, arising out of or related to your use of or inability to use our Site or Services, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the three (3) months immediately preceding the event giving rise to the claim, or €100, whichever is greater.

If the dispute cannot be resolved informally within thirty (30) days, the matter shall be submitted to mediation before pursuing formal legal proceedings. Nothing in this section prevents either party from seeking immediate injunctive or equitable relief from a competent court where necessary to protect intellectual property rights or confidential information. EU residents retain the right to submit complaints to the relevant national consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
